TORT (BODILY INJURY) MARKET

An area of law in which one party sues and seeks monetary compensation for injuries and losses suffered as a result of the fault or negligence of another party.  This contrasts with no-fault benefits (accident benefits) where benefits are paid without reference to fault.

FOCUS Assessments conducts Medical Evaluations which are utilized as a determination as to whether an individual’s injuries meet the verbal threshold on behalf of injured plaintiffs and defendants.

Our facility conducts assessments for both plaintiff and defendants.   We ensure the evaluator’s opinion expressed in the report is defensible, complete, competent and independent.  The test of independence is whether the expert would express the same opinion if given the same instructions by the opposing party.

The threshold is a “permanent serious impairment of an important physical, mental, or psychological function”. 

FOCUS Assessments’ staff and evaluators have been fully apprised of the Amendments to the Rules of Civil Procedures, which came into effect on January 1, 2010, which require significant changes to the practice and procedures governing the form and content of expert reports.
